1. DXL LOGISTICS Contracts with you
On this airway bill. ‘We’, ‘Our’, DXL LOGISTICS refers DXL LOGISTICS you and your refers to shipper, its employees, principal and agents , when you tender a
shipment to us you accept our terms for you, the sender and for your one else who has an expressed interest in the shipment. No one has any authority to change any of our terms of conditions or make any
promises on our behalf. The terms and conditions of this airway bill shall govern in the event of any inconsistancies that might exist in any other transportation documents accompanying shipment.
2. What shipment means :
Ashipment means all documents or parcels that travel under airway bill not just any single document and envelope included in shipment you certify that the shipment details are complete and accurate. And
this shipment is properly marked and packed to insure safe transportation with ordinary case in handling you agree that all shipment may be carried by any means, including airroad or any other carrier
unless you give specific instructions to the contrary.
3. International shipment :
You appiont us as your agents conduct customs entry and clearance and certify us as your consignee solely for the purpose of designation as your customers broker to perform customs and entry
clearance.
4. Shipment we do not accept :
We do not accept as a shipment anything that is considered restricted article, hazardous material by the department of transportation (DOT) International Air transportation Association (IATA) or the
International Civil Aviation Organization (ICAO).
5. Responsibility of Payment :
Even if you give us different payment instruction, you will always be primarily responsible for all charge and all duties, customs assessment government penalities and liens takes and/or attorney fees and
legal costa related to this shipment. You also will be responsible for any costs we may incur in returning you shipment to you or warehousing it pending disposition.
6. Claims:
if you wish to submit a claim for loss (include misdelivered) or damaged shipment the shippermust
Submit the claim in writing Your claim must be received within 15 days form the date we accept your shipment please note we will review a claim until all shipping and any other related charged owed have
been paid to us.
7. Right to inspect :
Your shipment at our option be inspected/opened at the request of government authorities at any time .

8. Delayed Shipment :
We will make every effort to deliver you shipment according to our regular delivery schedule. We are not liable for delays. Even if they our fault in Picking up shipment
Transporting a shipment (including delays caused by diversion) Delivering a shipment
We reserve the right without admitting liability to refund tranportions shipping charges so but are not obligated to do so
9. Circumstances beyond our control :
We are not liable if shipment is lost(include misdelivered) or damaged of because of Circumstances beyond of our control.
These circumstances incudes
An act God for example and earthquake cysione storm
Force Majeure for example war plane crash of ambairgo
Any action or omission by any outside FELfor example
The sender of the shipment
the receiver
An interested third party
Custom of Government officials
The postal service another carrier of a third party who we contact to delivery at destination that do not serve directly
We are not liable for electrical or magnetic damage to or erasure of electronic of photographics images or recording.
10.Consequential Damages :
We are not liable for the following. Whether theyarise in contration or any other form of civil aviation, including negligence and ever if they are our fault Consequential or special damages or loss Other direct

11. Extent of our liability :
Our liable for lost or damaged Shipment is limited to lowest of these three amounts.
INR 500/- The actual amount of loss or damage or
The actual value of the document of parcel this does not include any commercial value
12. What “ Actual Value” Means :
The lowest of the following amounts determined as at the time an the time and the place we accepted the shipment Document (meaning any shipment without commercial Value)
The cost of replacing reconstruction reconstituting the counter parcels meaning any shipment with commercial value.
The cost of reparing the parcel or
The relsale of fair markets value of the parcel
The actual value of the parcel cannot be more than the original cost to your plus 10 percent
